Employers may purchase this insurance to cover all
their workers falling within the definition of
"workman" in the Workmen's Compensation Act 1952
against personal injury by accident or disease
arising out of and in the course of their employment
with them. In addition, this policy also indemnify
the Employers being sued by their workers for
negligence.
Note:
a)
"Workman" is defined as any
person who has, either before or after the
commencement of this Act, entered into or
works under a contract of service or of
apprenticeship with the employer, whether by
way of manual labour or otherwise, whether
the contract is expressed or implied or is
oral or in writing, whether the remuneration
is calculated by time or by work done and
whether by the day, week, month or any
longer period.
b)
It is mandatory under
Section 26(2) of the Workmen's Compensation
Act 1952 that employers must insure all
their foreign workers under the approved
insurance scheme known as "Foreign Workers
Compensation Scheme".
