Policy Exclusions |

Exclusions For Driver &
Passenger Benefits Description
This Policy shall not cover:
| a. |
to loss caused directly or indirectly wholly
or partly
| i. |
by bacterial infections
(except pyogenic infections which shall
occur through an accidental cut or wound
sustained in a motor vehicle accident); |
| ii. |
by any other kind of
disease; |
| iii. |
by medical or surgical
treatment (except such as may be
necessary as a result of injuries
covered by this policy and performed
within the time provided in the policy); |
| iv. |
by childbirth or
miscarriage; |
| v. |
while the driver or
rider is under the influence of alcohol
or narcotics; |
| vi. |
while the vehicle is
used for illegal business pursuit or as
an unlicensed common carrier. |
| |

| b. |
to any bodily injury which shall result in
hernia; |
| c. |
to suicide or any attempt thereat (sane or
insane); |
| d. |
acquisition of prosthetic appliances not
limiting to artificial limbs, hearing aids,
crutches and implants; |
| e. |
costs/expenses of services of a non-medical
nature, such as television, telephones, telex
services, radios or similar facilities; |
| f. |
War and Civil War Exclusion |
It is hereby
declared and agreed that the Exclusion (f) of
this policy is deemed to be deleted and replaced
by the following:-
The policy shall not cover:-
To death or disablement or any other loss
caused directly or indirectly occasioned by
happening through or in consequence of war
invasion act of foreign enemies hostilities or
war-like operations(whether was be declared or
not) civil war mutiny riot strike commotion
military rising insurrection rebellion
revolution military or usurped power martial law
confiscation or nationalisation or requisition
or destruction of or damage to property by or
under the order of any Government or public or
local authority or any act of any person or
persons acting on behalf of or in connection
with any organisation the objects of which are
to include the overthrowing or influencing of
any de jure or de facto government by terrorism
or by any violent means.
Subject otherwise to the terms exceptions and
conditions of this policy.
Riot Strike and Civil Commotion Clause
Notwithstanding anything contained herein to
the contrary it is hereby declared and agreed
that this Policy is hereby extended to cover
Death or Loss or Disablement as herein defined
due to:-
| 1. |
Riot Strike and Civil Commotion provided
the Insured Person is not directly or
indirectly participating of such activities.
|
| 2. |
Riot Strike and Civil Commotion for the
purpose of this clause shall mean:-
| i. |
The act of any
person taking part together with
others in any disturbance of the
public peace (whether in connection
with a strike or lock-out or not). |
| ii. |
The action of any
lawfully constituted authority in
suppressing or attempting to
suppress any such disturbance or in
minimizing the consequences of any
such disturbance. |
| iii. |
The wilful act of
any striker or lock-out worker done
in furtherance of a strike or in
resistance to a lock-out. |
| iv |
The action of any
lawfully constituted authority in
preventing or attempting to prevent
any such act or in minimizing the
consequences of any such act. |
|
Provided this Clause shall not apply to any
Accident Death or Disablement or any other loss
directly or indirectly proximately or remotely
occasioned by contributed to by or traceable to
or arising out of or in connection with:-
| 1. |
war invasion acts of foreign enemies
hostilities or war-like operations (whether
war be declared or not) civil war. |
| 2. |
mutiny civil commotion assuming the
proportions of or amounting to popular
rising military rising insurrection
rebellion revolution military or usurped
power martial law confiscation or
nationalisation or requisition or
destruction of or damage to property by or
under the order of any government or public
or local authority or any act of any person
or persons acting on behalf of or in
connection with any organisation the objects
of which are to include the overthrowing or
influencing of any de jure or de facto
government by terrorism or by any violent
means. |
Subject otherwise to the terms exceptions and
conditions of this policy.
| g. |
to loss occasioned while the vehicle is used
for hire racing road rally pacemaking
speed-testing or use for any purpose in
connection with motor trade; |
| h. |
to the driver or rider if such driver or
rider does not hold a valid driving licence to
drive the automobile or is not qualified for
holding or obtaining such a valid driving
licence under the regulations of the Malaysia or
Singapore Road Transport Department; |
| i. |
to the rider or pillion rider not wearing an
approved crash helmet whilst engaging in
motor-cycling; |
| j. |
to persons under the age of 15 days and over
the age of 70 |
| k. |
to loss directly or indirectly caused by or
contributed to by or arising from;
| i. |
nuclear weapons material |
| ii. |
ionising radiations or contamination by
radioactivity from any nuclear fuel or from
any nuclear waste from the combustion of
nuclear fuel and for the purpose of this
exception combustion shall include any
self-sustaining process of nuclear fission. |
